  1. GENERAL INFORMATION
    1.1. Under the auspices of and in collaboration with the genuine rightsholder HYROX World GmbH, Hamburg/Germany (“HYROX World”), which is responsible for the overall management and international coordination of the event “HYROX – the World Series of Fitness Racing”, HYROX INDIA, Yoska Technology Solutions Private Limited with registered offices at 10 Deepanjali, 1st Cross, NGEF Layout, 2nd Stage, Bengaluru, Karnataka 560094 (“Local Organiser” or “we” or “us”), organises, manages, stages and delivers HYROX and HYROX YOUNGSTARS fitness races and events within the territory of INDIA (“Territory”) (“Event”) as the local event Organiser.
    1.2. HYROX fitness races are conducted in an event-series format in various cities around the world, with Regional Championships and World Championship as the respective season’s highlight and ending. The races operate in seasons, where a “season” shall mean the period of time commencing on the first day after the World Championship event and ending with the conclusion of the following World Championship event.
    1.3. HYROX fitness races are open to participants aged 16 and over and are generally organised as follows:

    1.3.1 as an individual competition (“Single Division”) in HYROX PRO MEN/PRO WOMEN, HYROX MEN/WOMEN, CHARITY HYROX MEN/WOMEN and HYROX ADAPTIVE MEN/ADAPTIVE WOMEN;
    1.3.2 as a partner competition (“Doubles Division”) in HYROX DOUBLES MEN/WOMEN/MIXED, HYROX PRO DOUBLES MEN/WOMEN and CHARITY HYROX DOUBLES MEN/WOMEN/MIXED; and
    1.3.3 as a relay competition (“Relay Division”) in HYROX RELAY MEN/WOMEN/MIXED and CHARITY HYROX RELAY MEN/WOMEN/MIXED.
    1.4 HYROX YOUNGSTARS races are organised as follows: as children’s race competitions for boys and girls in the following age-groups: (i) Boys/Girls 8-9, (ii) Boys/Girls 10-11, (iii) Boys/Girls 12-13, and (iv) Boys/Girls 14-15.
    1.5 The regulations of the HYROX Rulebook or the HYROX YOUNGSTARS Rulebook (as applicable) (available at: www.hyrox.com/rulebook and https://hyrox.com/hyrox-youngstars/) (the “HYROX Rulebook”) apply to athletes of the races at each Event.
  1. THESE TERMS & CONDITIONS
    2.1. These terms and conditions (“T&Cs”) set out and comprise the legal terms applying between the Local Organiser and purchasers of Event tickets or Event participants whether as an athlete or spectator (“Participant” or “you”) in relation to your registration to participate and your participation in an Event.
    2.2. By making a purchase for or participating in an Event, subject to the foregoing, you warrant that you are at least 18 years old (or the age of legal capacity in the country of purchase) and are able to enter into legally binding contracts. Children under the age of 18 and incapacitated adults may only participate in an Event if a parent or legal guardian has accepted these T&Cs on their behalf. Where you are registering a child under the age of 18 or an incapacitated adult as a Participant:

    2.2.1. you represent and warrant that you are the parent or legal guardian of that person;
    2.2.2. you represent and warrant that you have the legal authority to consent to their participation in the Event and enter into these T&Cs on their behalf; and
    2.2.3. you acknowledge and agree that any breach of these T&Cs by them will be deemed as a breach of these T&Cs by you.
    2.3. We reserve the right at our discretion to amend these T&Cs (and the format, date and structure of any Event), including if there is a change in the applicable laws, legislation, regulations, ruling or omission of any relevant government, court, competent national authority or governing body or amendments due to changes in the event structure. If we do implement such changes, we will notify you of any such changes in advance.
    2.4. Any person who is in breach of these T&Cs may be removed from an Event without the right to refund, compensation or re-admission. Please note, any specific terms stated at the point of ticket purchase shall take precedence over these Terms.
  1. AGE POLICY
    3.1. No unaccompanied under 16s are allowed at the Event. All under 16s must be accompanied by an adult ticket holder (aged over 18) at all times.
    3.2. Under 12s are admitted free but require child tickets in order to attend an Event. Over 12s must have a full price ticket to attend an Event.
    3.3. Where your child or dependent is participating in a race, it is your responsibility to ensure that your child/dependent is not left unaccompanied before or after their race. We reserve the right to disqualify and/or exclude you from participating in an Event at any time if you have left your child/dependent unattended.
    3.4. We do not accept any parental or supervisory duty of care or liability for any under 18s at an Event.
    3.5. All ages referred to are on “Race Date”.
  1. TICKETS, PRICING, PAYMENTS AND CONCLUSION OF CONTRACT
    4.1. Events have a limited capacity, therefore tickets for popular Events may sell out quickly. Prices may vary depending upon geographic markets, availability, selected start time window, venue requirements and/or regulations, and we reserve the right to change prices at any time.
    4.2. Unless otherwise indicated, all listed prices on our registration page are stated to be inclusive of VAT or GST. Ticket prices include a service fee for processing and administration (“service fee”) and, if applicable, a fee for flex options chosen (“Flex fee”). Service fees and Flex fees are non-refundable, unless otherwise stated in these terms and conditions.
    4.3. Payment methods vary and the accepted payment methods are as stated on the platform where your ticket is purchased.
    4.4. Vivenu, Inc. (“Vivenu”) acts as the service provider for the Local Organiser in connection with the registration process for the Events.
    4.5. Purchases are subject to credit card approval, and are processed only after a billing address, and other billing information, has been verified. Occasionally, we receive incorrect billing or credit card account information for a purchase that can delay processing and delivery. In these cases, our customer services will attempt to contact you, using the information provided at the time of purchase. If we are unable to reach you after our initial attempt, we may cancel your order without further notice (in which case you will not be charged).
    4.6. If you do not receive a confirmation email after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm via HYROX customer service – india@hyrox.com whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for technical faults or any losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.
    4.7. Once we confirm your purchase by email, a binding contract is entered into between us for you to participate in or attend the relevant Event in accordance with, and subject to, these T&Cs (to the exclusion of all other terms and conditions save where expressed to the contrary in these T&Cs).
    4.8. If payment is not processed for any reason whatsoever, the Local Organiser is entitled to terminate the contract immediately without liability. You shall be liable for all costs reasonably associated with such termination.
    4.9. Where available, discount or payment codes issued by us are accepted as a form of payment for registration, subject to any applicable terms and conditions. Discount or payment codes issued are personal to the recipient and may not be transferred, sold, or assigned to any other person or third party.
    4.10 If you are a consumer located in a jurisdiction where local laws grant you specific rights of cancellation, refund, or withdrawal that cannot be excluded by contract, those statutory rights shall take precedence over these T&Cs. You acknowledge and agree that these T&Cs relate to services for a leisure activity to be provided on a specific date or period, and statutory rights of withdrawal (and “cooling-off periods”) do not apply in certain jurisdictions.
  1. TICKET CONDITIONS, REFUNDS AND CHANGES
    5.1. Before completing any purchase, you should carefully review your purchase. We offer a 24-hour refund policy for unused tickets purchased online. After 24-hours, sales are final and purchases are not refundable except as expressly set out in these T&Cs.
    5.2. Once purchased, purchases cannot be transferred, exchanged, refunded or returned, except as detailed in this Section 5.
    5.3. The following terms apply to tickets for the Event:

    TypesConditions

    Athlete Standard (Non-Flex)
    • No returns, refunds, transfers or changes, including to athlete name, division, event or age group selected.
    Athlete Flex
    • Ticket may be returned up to 07.59am (Event time zone) 7 days before your race day for a refund.
    • Refund amount will depend on when a ticket is returned, as follows:
      • 100% refund: if returned before 07:59 a.m. (Event time zone) 31 days before your race.
      • 50% refund: if returned before 07:59 a.m. (Event time zone) 7 days before your race.
      • No refund if returned less than 7 days before your race.
      • Service fees and Flex fees are non-refundable.
    • One (1) name change per athlete per ticket for each name (to a person of the same gender) may be made up to 7:59am (Event time zone) one day before your race.
    • No changes may be made to the division, event or age group selected at any time.
    • Not available for Charity Tickets and World Championship Tickets
    • No part returns. Every return will cover the entire ticket and all athletes (including for Doubles Division or the Relay Division).
    • Not available for purchase 6 weeks or less before your race.
    Athlete Lite Flex
    • No returns or refunds.
    • One (1) name change per athlete per ticket (to a person of the same gender) may be made up to 7:59am (Event time zone) one day before your race.
    • No changes may be made to the division, event or age group selected at any time.
    • Not available for Charity Tickets or World Championship Tickets
    Athlete World Championships
    • By invitation only.
    • In the Doubles Division, one (1) name change per ticket (to a person of the same gender and same age group) may be made where one athlete is unable to compete due to proven illness or injury, provided a valid medical certificate is presented and subject to HYROX’s approval in its sole discretion. HYROX will not be able to accommodate any personalised items for late changes (less than 4 weeks before race date).
    • Except as provided above, no returns, refunds, transfers or changes are permitted, including to athlete name, division or the event selected.
    Spectator
    • No returns, refunds or changes, including to the event selected.
    • Transfers permitted.
    5.4. Each HYROX YOUNGSTARS ticket shall include one complimentary Spectator Ticket for a legal guardian or representative.
    5.5. In relation to Adaptive tickets, “adaptive” athletes are defined under the HYROX Rulebook. If an athlete purchases an adaptive ticket and the Local Organiser in its sole discretion determines they do not fall under any adaptive definition, the Local Organiser has the right to cancel the purchase and refund the fee, with no further liability to you. You must exercise cautious judgment when purchasing and if uncertain, first contact us at (https://hyrox.com/contact/) before purchasing.
    5.6. Where permitted by ticket terms, any name changes must be made online via your HYROX account.
    5.7. It is your responsibility to ensure that you can participate in the Event for which you purchased a ticket and we will not be responsible for your inability to participate for any reason. For example, if you have purchased tickets for two different races on the same day, we will not be liable if you cannot participate in both races because the race times overlap.
  1. UNLAWFUL RESALE OF TICKETS
    6.1. Unlawful resale (or attempted resale), counterfeit or copy of Event tickets or promotional codes are grounds for seizure and cancellation without compensation. You are responsible for complying with all applicable ticket resale laws. Promotional codes or passes may not be used for advertising, promotions, contests, or sweepstakes, unless formal written authorisation is given by us.
  1. ADDITIONAL THIRD-PARTY PRODUCTS
    7.1. Event Photography (Sportograf)

    7.1.1. Event photography is provided by Sportograf Digital Solutions GmbH, whose registered office is at 170 Süsterfeldstrasse, 52072, Aachen, Germany (“Sportograf”). If you choose to purchase Sportograf products, you agree to be bound by the terms and conditions of Sportograf which can be found at https://www.sportograf.com/en/agb in addition to these T&Cs and that any use of your personal data shall be subject to Sportograf’s privacy policy.
    7.1.2. You acknowledge that the Local Organiser acts as an agent for the sale of the Sportograf product. To the maximum extent permitted by law, the Local Organiser disclaims all liability for any defects, delays, or issues arising from the Sportograf product. Any claims or disputes regarding the Sportograf product must be directed to Sportograf.
  1. CHARITY PLACES & FUNDRAISING DECLARATION
    8.1. If participation in support of or on behalf for our charity partner (“Charity”) is available in respect of the Event and you decide to participate in support or on behalf of that Charity by purchasing a corresponding charity ticket (“Charity Ticket”), you acknowledge that: (i) such participation will incur a cost to the Charity; (ii) such cost and a fundraising model is agreed in advance between HYROX World and the Charity; (iii) a contract will be entered into between you and the Charity in such regard (“Charity Contract”); neither HYROX World nor any other company affiliated with us (together “HYROX Companies”) will be a party to the Charity Contract, and in addition to your contract with us and these T&Cs, your participation in any Event shall also be subject to your Charity Contract; and (iv) you agree that your participation shall be subject to the following conditions:

    8.1.1. you have pledged to fundraise donations to such charity for a minimum amount as set out in the Event booking form or such other amount agreed by the Charity (and you shall evidence such fundraising in writing upon HYROX World’s, other HYROX Companies’ or the Charity’s request);
    8.1.2. if the Event is cancelled by the Local Organiser pursuant to clause 7.1, and you elect not to rebook for an alternative Event pursuant to clause 7.2, all monies you have raised on behalf of the Charity will be paid to the Charity;
    8.1.3. if the Event is cancelled by the Local Organiser pursuant to clause 7.1, and you elect to rebook for an alternative Event pursuant to clause 7.2, all monies you have raised on behalf of the Charity will not be refunded to you, and will instead apply to the HYROX Event for which you are then registered; and
    8.1.4. if, prior to the Event taking place, the Charity elects to terminate its partnership with HYROX, the HYROX Companies or the Event, your Charity entry to the Event will remain unchanged..
  1. EVENT REGISTRATION & PARTICIPATION
    9.1. The Local Organiser reserves the right to disqualify and/or exclude you from participating in and/or attending an Event at any time and without any right to a refund if:

    9.1.1. you have failed to personalise your ticket before the Event;
    9.1.2. you do not possess a valid ticket;
    9.1.3. you provide us with false information or fail to provide proof of identity/ age;
    9.1.4. there is reasonable suspicion that you are not in generally good health or physical condition or if you are showing any typical symptoms of illness (including but not limited to shortness of breath, coughing or fever);
    9.1.5. there is reasonable suspicion that you are in possession or under the influence of any illicit substances (performance-enhancing or otherwise) at the time of any Event, or
    9.1.6 your actions and/or omissions (whether before, during or after any Event) in the opinion of the Local Organiser or owner of the Event venue endanger the safety of the Event, its Participants or violate any Event Rules. “Event Rules” shall mean all applicable laws, posted rules and warnings, safety announcements, event and venue policies and regulations (including but not limited to the HYROX Event Code of Conduct) provided or notified to you by the Local Organiser and/or the owner of the Event venue (the “Venue Owner”).
    9.2. You understand and agree that you are expected to exhibit appropriate behaviour at all times while at the Event, to obey the Event Rules and abide by any decision of any Event official relative to your ability to safely participate in or attend the Event. This includes, generally, respect for other people, equipment, facilities, or property.
    9.3. For access control reasons, we may provide Participants at certain Events with electronic wristbands containing a RFID chip. The RFID chip contains digital information confirming the Participant’s authorisation to access the Event as well as the functionality to be used for cashless payment. The terms and conditions governing your use of the RFID wristband are set out in the Annex.
    9.4. You may take your own photographs, audio recordings or video footage at the Event for private and personal use only. You must not publish, post, distribute, sell, license, commercially exploit or use any such material in a manner which could misrepresent, harm or negatively impact the Event, the Participants, HYROX or its partners. HYROX may request removal of any content that breaches this condition, and you agree to comply promptly with any such request.
    9.5. You shall not plan, organise, lead, promote or endorse any commercial activity relating to your, if any, own business or the business of a third party that is not contracted to the Local Organiser or HYROX World in connection with the Event and/or as a HYROX sponsoring partner.
    9.6. Athlete Terms

    9.6.1. By participating in the Event, you accept that your participation is governed by the HYROX Rulebook and you are bound by its terms.
    9.6.2. In addition to its rights under clause 9.1 above, the Local Organiser reserves the right to disqualify and/or exclude you from participating in an Event at any time and without any right to a refund if:

    9.6.2.1. you provide false personal information to us during registration, including information regarding your biological gender at birth and nationality (where applicable);
    9.6.2.2. you do not possess a QR-/barcode assigned to your ticket and an official start number;
    9.6.2.3. you do not meet the eligibility requirements for the race that you are registered for;
    9.6.2.4. for Elite 15 athletes, you fail to hold and produce a valid Athletes License granted to you by HYROX World for the corresponding season; or
    9.6.2.5. where applicable, you are suspended by another sports or anti-doping organisation.
    9.6.3. You must check your starting documents for completeness upon receipt. The timing chip, contained in the starting documents, must be returned to the Event staff in the finish area immediately after crossing the finish line. If the timing chip is lost or damaged, the Local Organiser reserves the right to recover from you all attributed costs summing up to an amount equalling USD 100 (US dollar one hundred) in local currency.
    9.6.4. We will notify you of your race time and start wave before the Event. You will not be allowed to participate if you miss your race time or start wave.
    9.6.5. You acknowledge and agree that, as stated in the applicable HYROX Rulebook, official rankings are based on athletes’ biological gender at birth, in line with Olympic guidelines. Individuals who wish to register under a gender different to their gender at birth may participate recreationally but may not be included in any official rankings.
    9.6.6. Assumption of risk & medical care

    9.6.6.1. Participation in any Event is at your own risk and requires that you are healthy and in good physical condition. It is your responsibility to check your health beforehand. With your registration, accreditation and participation, you expressly declare that you are aware of the specific dangers of the Event and that there are no health concerns regarding your participation. We reserve the right at any time to request confirmation on the state of your health and you agree to disclose your state of health (including supporting confirmation from a qualified medical professional, for example in the form of a doctor’s note) on such request.
    9.6.6.2. You acknowledge and agree that: (i) your physical condition and/or state of health may change during the period between registering to participate in an Event and the participation (including but not limited to viral infection, illness, injury or pregnancy); and (ii) you bear this risk alone and you are not entitled to a refund if you cannot participate due to subsequent changes to your physical condition and/or state of health.
    9.6.6.3. In relation to medical matters, you agree that:

    9.6.6.3.1. If you become ill during or after an Event and/or receive medical attention or treatment either from medical staff, other medical service providers to the Events as contracted by the Local Organiser, or any doctor or hospital, you authorise such persons to provide details (including details of medical treatment) to the Local Organiser or others authorised by them; and
    9.6.6.3.2. you consent to medical assistance and/or medical care being given to you in the case of illness, injury or an emergency situation, should this occur during an Event, such assistance to be given by the Local Organiser, its employees, contractors or other trained personnel conducting the Events (which may include the use of anaesthetics).
  1. SAFETY AND SECURITY
    10.1. You and your belongings may be searched on entry to or at the Event. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to or ejected from the Event without refund or other compensation. Certain items may not be brought onto the premises of any Event Venue, including without limitation, alcohol, drugs, controlled substances, firearms, or knives.
    10.2. You understand and agree that you are responsible for taking care of your own belongings during the Event and, to the maximum extent permitted by law, neither The Local Organiser nor the Venue Owner is responsible for any personal item or property that is lost, damaged or stolen at the Event.
    10.3. The carrying and bringing of animals to Events is prohibited, with the exception of guide dogs.
  1. FORCE MAJEURE EVENT, POSTPONEMENT AND CANCELLATION OF THE EVENTS
    11.1 Local Organiser is under no obligation to hold the Events in its entirety or in parts and, subject to the remainder of this clause 11, may without further liability postpone or cancel the Event in full or in part, or change the time or location of, any or all of the Events for any reason, including due to:

    11.1.1. circumstance not within the Local Organiser’s reasonable control, including but not limited to severe weather conditions, natural disasters (such as floods, hurricanes, earthquakes, or fires), epidemics, pandemics, global health crises, war, terrorism, civil unrest, labor disputes, strikes, government actions, embargoes, power failures, economic impossibility and low entry numbers;
    11.1.2. on advice of any security or police force, health authority and/or local authority consent or approval (or withdrawal of such consent or approval) or for any reason that would affect the safety and security of Participants, or the feasibility of the Event to be held; or
    11.1.3. any changes to applicable Laws, legislation, regulations, ruling or omission of any relevant government, court, competent national authority or governing body,(“Force Majeure Event”).
    11.2. If any Event for which you are registered is cancelled or postponed due to a Force Majeure Event or for any other reason, you shall be entitled to a free rebooking at a next year’s edition of the same Event. If you are unable to attend that Event, you have 30 days to inform us in writing and you may request a free rebooking to an alternative Event of your choice taking place within the region during the same or next season (subject to availability).
    11.3. If your race during the Event for which you are registered is cancelled for whatever reason, the Local Organiser (may at its reasonable discretion) either repeat the affected race the same day or on another day during the same Event. In such circumstances, the ranking or the athlete’s position during the unfinished race shall not apply or be taken into consideration.
    11.4. Under no circumstances will we be liable for travel, accommodation or any other expenses that you or anyone else incurs in connection with a cancelled or postponed Event, or any deferral.
    11.5. We reserve the right to alter the start time of the Event. In the event of a change of start time you will be notified of the revised start time with as much notice as reasonably practicable. No refund in full or in part shall be made for any change in start time for the Event, provided the Event takes place on the specified date of the Event.
    11.6. We reserve the right to amend the Event format, including changing the course and the distance, at our sole discretion. If the Event format, course, or distance, is changed, you will not be entitled to any refund and there shall be no further liability whatsoever arising from such change of format, course, or distance.
  1. ASSUMPTION OF RISK, WAIVER AND LIMITATION OF LIABILITY
    12.1. You understand and agree that there are certain risks inherent in attending any event, including a sporting event, and voluntarily assume all risk of property loss or damage, personal injury, illness and/or death arising in connection with the your attendance at the Event (e.g., by entering the venue and/or attending the Event), including, without limitation, objects or fragments thrown or flying into the spectator area, a venue’s stands, concourses and/or concession areas during an Event, special effects at an event, acts or omissions of other spectators and risks related to any resulting disease. You understand and agree that these risks cannot be fully eliminated.
    12.2. You voluntarily assume all known and potential risk and danger of property loss, illness (including sickness, whether airborne or otherwise, and other risks of exposure to any communicable disease or illness or a bacteria, virus or other pathogen capable of causing a communicable disease or illness), injury and/or death from any cause, resulting from, in connection with, or incidental to the Event, whether occurring prior to, during or after the Event.  You agree that the Releasees (defined below) shall not be responsible or liable for any claim, loss, damage or injury, whether occurring before, during, or after the event, regardless of whether caused by the negligence or other fault of Releasees or any third party.
    12.3. To the fullest extent permitted by applicable law, you hereby expressly waive and release any and all claims, now known or hereafter known in any jurisdiction throughout the world, against the Local Organiser, HYROX World, and their respective officers, directors, manager(s), employees, agents, affiliates, shareholders/members, successors, and assigns (collectively, “Releasees”), on account of injury, disability, death, or property damage arising out of or attributable to your attendance at the Event, whether arising out of the negligence of the Local Organiser or any Releasees or otherwise. You covenant not to make or bring any such claim against the Local Organiser or any other Releasee, and forever release and discharge the Local Organiser and all other Releasees from liability under such claims.
    12.4. To the maximum extent permitted by law, we (including our affiliates, parent undertakings, subsidiaries, and their respective officers, directors, employees, agents, legal representatives and sub-contractors) and our partners shall not be liable for any loss, injury or damage to any person (including you) or property howsoever caused:

    12.4.1. in any circumstances where there is no breach of contract or a legal duty of care owed by us or our partners; and
    12.4.2. in circumstances where such loss or damage is not directly as a result of any such breach (save for death or personal injury resulting from our or a partner’s negligence).
    12.5. Subject to Section 12.6 below, you agree that:

    12.5.1 the Local Organiser shall not be liable to you for any reason under or in relation to these T&CS, or an Event for any: (i) loss of profit; (ii) loss of reputation; (iii) loss of data; (iv) loss of business, revenue or goodwill; (v) loss of anticipated savings; (vi) pledges made on your behalf or by you to a charity; (vii) your travel, accommodation  or other expenses incurred in relation to any cancelled or postponed Event; (viii) any other indirect or consequential loss or damage, in each case regardless of whether such loss or damage is reasonably foreseeable or is in the contemplation of parties; and
    12.5.2. the Local Organiser’s maximum liability to you, for any reason or cause whatsoever, shall not exceed the total amount of monies received by the Local Organiser from you.
    12.6. Nothing in these T&Cs shall be construed as limiting or excluding the Local Organiser’s liability for: (i) death or personal injury resulting from negligence; (ii) fraud or fraudulent misrepresentation or (iii) any other matter for which it would be illegal or unlawful to limit, exclude or attempt to exclude liability. Your statutory rights as a consumer are not affected by these T&Cs.
    12.7. The Local Organiser takes no responsibility for allergens contained in food and drink provided at the Event.
  1. PRIVACY AND DATA PROTECTION
    13.1. We process and share your personal data with our partners in accordance with our privacy policy which can be found on our website.
    13.2. Provided you give us prior permission, HYROX World and its affiliated companies and partners and/or third parties may contact you, to provide you with newsletters and other communications regarding HYROX’s or such third parties’ products, services and events. These messages will be sent to you based on your messaging preferences and you can unsubscribe at any time.
  1. RECORDING, TRANSMISSION AND EXHIBITION
    14.1. You agree that the Event is a public event, that your appearance and actions inside and outside the venue where the Event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the Event.
    14.2. You hereby grant permission to (i) the Local Organiser, HYROX World, members of its group, its partners and its affiliates (“HYROX Parties”), (ii) any parties authorised by or acting on behalf of the HYROX Parties, and (iii) accredited members of the media, to film, capture and record your participation in the Event. Such permission includes the right to photograph, film, record and/or otherwise capture your name, image, likeness, voice, written statement, photograph and/or any other biographical information, in any media format.
    14.3. You acknowledge and agree that any and all photographs, video, film, motion pictures, recordings and content captured during the Event by or on behalf of the HYROX Parties shall be their sole property.  You acknowledge and agree that such photographs, motion pictures, recordings and content containing your name, image, likeness, voice, written statement, photograph and/or any other biographical information may be edited, exhibited, disseminated, adapted, modified, copied, used and/or exploited by the HYROX Parties, in whole or in part, in all media and formats, throughout the world, in perpetuity, for any legitimate commercial or non-commercial purpose, including but not limited to promoting, advertising and marketing HYROX products and services and the events held by the HYROX Parties, without prior notice, approval or compensation.
    14.4. If you have concerns regarding your image being used in our materials, please contact HYROX Customer Services or visit the Registration Desk on the day of the Event. We will make reasonable efforts to accommodate your request but cannot guarantee complete exclusion from all group or background imagery.
  1. HYROX INTELLECTUAL PROPERTY RIGHTS
    15.1. HYROX World is the sole owner of the trademark “HYROX,” and all related intellectual property rights relating to HYROX – The World Series of Fitness Racing, including but not limited to any brand logos, guides, documents created by HYROX World as well as images, audio-visual recordings (e.g., highlights, clips, snippets) produced at the Event or by any authorised third party (together “HYROX IP”).
    15.2. You are not permitted to use the HYROX IP without the express written consent of HYROX World.
    15.3. Nothing in these T&Cs grants you the right to use or reproduce the HYROX name or logo in any manner that implies a partnership, sponsorship, endorsement, or affiliation with HYROX.
  1. GENERAL
    16.1. These T&Cs have been drafted in the English language and may be translated into other languages. In the event of any discrepancy between the English and any translated version, the English language version shall prevail.
    16.2. The contract between us constitutes the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to our contract which is not already set out in these T&Cs.
    16.3. If any term, condition or other provision of these T&Cs are determined by a court of competent jurisdiction to be invalid, illegal or incapable of being enforced by any rule of law or public policy, it shall be deemed to be deleted from these T&Cs, and all other terms, conditions and provisions of these T&Cs shall nevertheless remain in full force and effect.
  1. HYROX INTELLECTUAL PROPERTY RIGHTS
    17.1. These T&Cs, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the country in which the Local Organiser is domiciled.
    17.2. The courts of the country in which the Local Organiser is domiciled shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these T&Cs.
